01Agreeing to these terms
These Terms of Service (the “Terms”) are a binding agreement between you and Acyera (“Acyera”, “we”, “us”, or “our”). They cover your access to and use of the Acyera platform, including the dashboard, the page editor, the Sandbox, the AI features, the sites you publish, and every related service we offer (together, the “Service”).
By creating an account, publishing a site, or otherwise using the Service, you accept these Terms and the other documents they refer to. Those documents include our Privacy Policy, Cookie Policy, Acceptable Use Policy, Billing and Refunds Policy, and, if you take part in it, the Partner Program Terms. If you do not agree with any part of them, please do not use the Service.
If you are using Acyera for an organisation, you confirm that you are allowed to accept these Terms on its behalf, and “you” then means that organisation.
02Who can use Acyera
You may use Acyera only if you can form a binding contract with us and are not barred from doing so under any law that applies to you. You must be old enough to consent to the handling of your own data where you live. If your local law sets a minimum age for online services, you meet it.
Acyera is a general-purpose tool used by people around the world. Wherever you are, you are responsible for making sure your own use of the Service, and everything you publish, is lawful in the places you operate and reach an audience.
03What Acyera provides
Acyera lets you assemble pages from typed content blocks, style them without writing code, and publish them to a web address. Every site gets a free subdomain, and eligible plans can connect a custom domain. We handle the hosting, the rendering, the search-engine plumbing, and the day-to-day running of the platform so that you can focus on your content.
The Service also includes optional features such as AI-assisted page generation, an in-editor design assistant, a support assistant, media hosting, forms, comments, reviews, discussion features, analytics, backups, and advertising and monetisation tools. Which features you can use depends on your plan.
We are always improving Acyera. We may add, change, or retire features, and we may set or adjust limits such as the number of sites, pages, or storage a plan includes. When a change would meaningfully reduce a paid feature you rely on, we will give you reasonable notice.
04Your account
You need an account to publish and manage sites. You agree to give accurate details, to keep them current, and to keep your login credentials private. Authentication is handled through Firebase Authentication.
- You are responsible for everything that happens under your account, whether or not you authorised it.
- Tell us promptly if you believe someone has gained access to your account without permission.
- Do not share, sell, or transfer your account to anyone else without our written agreement, and do not use someone else’s account without their permission.
- On plans that support team members, the account owner is responsible for the people they invite and for the content those members create.
05Plans, billing, and renewals
Acyera offers a genuine free plan and several paid plans. Paid plans unlock additional blocks, higher limits, custom domains, and other capabilities. The features and prices of each plan are shown at the point of purchase.
Paid subscriptions are billed in advance for the cycle you choose and renew automatically at the end of each cycle until you cancel. Payments are processed by our payment partner, PesaPal, which supports mobile money and card networks. We do not store your full payment-card details on our own systems.
You can cancel at any time to stop the next renewal, and your paid features remain available until the end of the cycle you already paid for. We may change plan prices, and when we do we will give you advance notice before the change affects your next renewal. Prices are exclusive of any taxes that apply to you, and you are responsible for those taxes unless the law requires us to collect them.
06Your content and the licence you give us
“Your content” means everything you create, upload, or publish through Acyera, including text, images, media, site settings, and the block trees that make up your pages. As between you and us, you own your content and keep every right you had in it before you brought it to Acyera.
To run the Service, we need your permission to handle your content. You grant Acyera a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, adapt for display across devices, back up, and publicly show your content, but only as needed to operate, secure, and improve the Service and to deliver your sites to the visitors you choose to reach. This licence lasts while your content is on the platform and for a short, reasonable period afterwards while backups and caches clear.
You are responsible for your content. You confirm that you hold the rights to everything you publish and that it does not break the law or these Terms. You can export your content at any time using the backup feature, which gives you a portable copy of your site.
If you send us feedback or suggestions, you allow us to use them freely to improve Acyera, without any obligation to you.
07AI features and generated content
Acyera includes AI features that can draft a page from a description, edit a page you already have, and answer questions about the platform. To provide them, the text and instructions you supply are processed by us and by trusted AI providers that power these features.
- AI output is a starting draft, not a finished or verified result. It can be inaccurate, incomplete, or generic. You are responsible for reviewing, correcting, and approving anything the AI produces before you publish it.
- As between you and us, you own the pages you publish that were assisted by AI, on the same basis as the rest of your content, and subject to any terms of the underlying providers.
- You must not use the AI features to produce content that breaks our Acceptable Use Policy or to work around the limits, permissions, or moderation built into the Service.
- Similar text can be generated for different people, so we cannot promise that AI-assisted output is unique to you.
08Acceptable use
You agree to use Acyera responsibly and lawfully. In short, do not publish content that is illegal, harmful, deceptive, or infringing, and do not attack, overload, or try to break the platform or other people’s sites.
The full list of what is and is not allowed is set out in our Acceptable Use Policy. It forms part of these Terms, and breaking it is a breach of this agreement.
09Subdomains and custom domains
Every site receives a free subdomain in the form yourname.acyera.com. Eligible plans can also connect a custom domain that you own and control.
- You must not choose a subdomain or site name that impersonates someone else, infringes a trademark, or is designed to mislead. We may reclaim, rename, or withhold subdomains that break these Terms or a third party’s rights.
- For a custom domain, you are responsible for registering and renewing it and for keeping its DNS settings correct. Your rights in a domain you register with a third party are governed by that registrar, not by us.
- Subdomains remain part of Acyera’s namespace and are provided for use with the Service. They are not sold to you.
10Visitor content and moderation
If you enable features such as comments, reviews, contact forms, or discussions, visitors to your site may submit their own content. You decide whether to turn these on, and you are responsible for moderating what appears on your site and for meeting any obligations you owe to your visitors.
Acyera also operates its own safety measures across the platform. We use a layered review process that combines fixed rules with automated screening, and it is built to fail safe, which means it holds back or blocks material it cannot clear rather than letting it through. Where we run this review, we may screen, restrict, hide from search engines, remove, or refuse to publish content, and we may do so without notice when the risk is serious. We are not obliged to monitor everything, and running these measures does not make us the author of, or responsible for, content that others create.
11Third-party services
Acyera works alongside services provided by other companies, such as cloud hosting and authentication, domain and security providers, payment processing, AI providers, mapping, messaging, and advertising. Some features only work because these services do.
When you use a feature that relies on a third party, that third party’s own terms may also apply to you. We choose our providers carefully, but we do not control them, and we are not responsible for their acts or omissions beyond what the law requires of us.
12Intellectual property and takedowns
Acyera, including the platform, its software, its design system, its block library, and its brand, is owned by us and our licensors and is protected by intellectual-property laws. These Terms do not give you any right in the Acyera brand, and you may not copy, resell, or create a competing service from the platform.
We respect the intellectual-property rights of others, and we expect you to do the same. If you believe content on a site hosted by Acyera infringes your rights, contact us with enough detail to identify the content and your claim, and we will review it and act where appropriate, which may include removing the content or disabling the account responsible.
13Suspension and termination
You can stop using Acyera at any time and delete your sites or account from the dashboard. Deleting a site or page is permanent, so please export a backup first if you might want the content later.
We may suspend or end your access to all or part of the Service if you break these Terms, if your use puts other users, the public, or the platform at risk, if we are required to by law, or if we stop offering the Service. Where it is reasonable and safe to do so, we will give you notice and a chance to put things right first. For serious or repeated breaches, we may act immediately.
When your account ends, your right to use the Service stops, and we may delete your content after a reasonable period. Terms that by their nature should survive, such as content licences already granted, disclaimers, limits on liability, indemnities, and dispute resolution, continue to apply after termination.
14Disclaimers
We work hard to keep Acyera fast, secure, and available, but the Service is provided “as is” and “as available”. To the fullest extent the law allows, we do not make promises or warranties that are not written into these Terms, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components, that results such as search rankings, traffic, or income will be achieved, or that content will never be lost. Regular backups are your best protection, and we give you the tools to make them.
Some places do not allow certain warranties to be excluded. Where that is the case, the exclusions above apply only to the extent permitted, and you may have rights that these Terms do not override.
15Limitation of liability
To the fullest extent the law allows, Acyera and the people who work with us will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, goodwill, data, or business opportunity, arising out of or relating to the Service, even if we were told such damages were possible.
To the fullest extent the law allows, our total liability for all claims relating to the Service in any twelve-month period is limited to the greater of the amount you paid us for the Service in that period or one hundred United States dollars.
Nothing in these Terms limits liability that cannot be limited by law, such as liability for fraud or for death or personal injury caused by negligence. Where a limitation is not allowed where you live, it applies to you only to the extent permitted.
16Your indemnity to us
You agree to defend, indemnify, and hold Acyera and the people who work with us harmless from claims, losses, and costs, including reasonable legal fees, that arise from your content, your use of the Service, your breach of these Terms, or your violation of any law or any right of another person. We may take over the defence of a claim you are indemnifying, and if we do, you agree to cooperate with us.
17Disputes and arbitration
Almost every concern can be settled quickly by talking to us, so please contact us first. If you have a dispute, you agree to raise it with us and to give us thirty days to resolve it informally before starting any formal proceeding. We will do the same before bringing a claim against you.
If a dispute is not resolved within that period, you and Acyera agree to settle it by final and binding individual arbitration rather than in court, except that either of us may bring a claim in a small-claims forum where it qualifies, and either of us may seek an injunction to protect intellectual property or stop misuse of the Service. The arbitration is conducted by a neutral arbitrator under a recognised set of arbitration rules, in the English language, and it may be held remotely or in a place both sides agree on.
Disputes are handled only on an individual basis. You and Acyera each waive any right to bring or take part in a class action, a collective action, or a representative proceeding. The arbitrator may not combine more than one person’s claims into a single case.
If the class-action waiver above is found unenforceable for a particular claim, that claim, and only that claim, is separated out and handled in court, while the rest stays in arbitration. Nothing in this section takes away any right you have under the law where you live that cannot be waived by agreement.
18Changes to these terms
We may update these Terms as Acyera grows and as the law changes. When we make a material change, we will update the “Last updated” date at the top and, where appropriate, tell you through the platform or by email before the change takes effect.
If you keep using the Service after an update takes effect, you accept the updated Terms. If you do not agree with a change, your remedy is to stop using the Service and, if you wish, to close your account.
19General terms
- Neutral, global agreement. These Terms are written to apply wherever you use Acyera and are not tied to the law of any single country. Where a mandatory local law gives you rights that this agreement cannot remove, those rights still apply to you.
- Entire agreement. These Terms and the policies they refer to are the whole agreement between you and us about the Service, and they replace any earlier understanding on the same subject.
- Severability. If any part of these Terms is found unenforceable, the rest stays in force, and the unenforceable part is applied to the maximum extent allowed.
- No waiver. If we do not enforce a right straight away, we do not give it up.
- Assignment. You may not transfer your rights under these Terms without our consent. We may transfer ours to an affiliate or in connection with a merger, acquisition, or sale of assets, on notice to you.
- Force majeure. We are not responsible for delays or failures caused by events beyond our reasonable control.
- Notices. We may give you notices through the platform or by email to the address on your account. You can reach us using the contact details below.
